Offer in Compromise
The firm represents clients in all types of collection matters before the IRS, the Franchise Tax Board, the California State Board of Equalization and the Employment Development Department and assists clients in finding solutions to their tax collection problems. One possible solution that is available to taxpayers who owe money to the IRS and/or California tax agencies is an Offer in Compromise (“OIC”). An OIC allows a taxpayer to settle their unpaid tax liability by paying less than the amount owed. This solution typically requires a detailed financial disclosure by the taxpayer. Each tax agency has its own rules and procedures which govern when a taxpayer will be allowed to pursue an OIC and how much the taxpayer will have to pay if the taxpayer wants to enter into an OIC. The attorneys in our office assist individuals, shareholders, partners, members, corporations, LLC’s partnerships, estates, and others in determining whether pursuing an OIC is an appropriate strategy, and in pursuing an OIC if that strategy is appropriate and the client wishes to pursue that strategy.
